Danny Masterson gives Bijou Phillips custody of daughter after jail sentence
Danny Masterson has agreed that his estranged wife, Bijou Phillips, should have full custody of their daughter as he serves a 30-year prison sentence for rape.
According to documents obtained by TMZ, the “That 70’s Show” alum, 47, wants Phillips to have both legal and physical custody of their daughter, Fianna, 9.
Masterson requested visitation, which would have to be supervised by prison officials if granted.
The Post reached out to a rep for Masterson for comment.
Phillips stood by Masterson’s side during his court hearings. He was officially sentenced to 30 years to life on Sept. 7, for two rapes he committed in 2003.
Days later, she filed for divorce.
“Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter,” Phillips’s attorney, Peter A. Lauzon, told TMZ at the time.
“This period has been unimaginably hard on the marriage and the family. Mr. Masterson was always present for Ms. Phillips during her most difficult times of her life. Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter,” he concluded.
Before the filing, Phillips wrote a support letter to the judge.
“Our daughter and I are heartbroken that he is not home with us,” Phillips wrote. “It has been very difficult without him here. Even though he is now in jail, he calls her every day. He helps her with homework every night. He teaches her math with kindness and patience.”
“We need him more than you can imagine,” she continued. “I know he has been convicted of serious crimes. But the man I married has only been an extraordinary husband to me and a devoted father to our daughter.”
The couple met in 2004 and tied the knot in 2009. They welcomed Fianna on Feb. 14, 2014.
