Danny Masterson’s ex Bijou Phillips lists divorce demands after rape sentencing

Danny Masterson’s estranged wife, Bijou Phillips, is seeking spousal support in the petition for the dissolution of their marriage.

Phillips filed for divorce from the “That ’70s Show” actor, 47, on Monday in a California court citing “irreconcilable differences.” A separation date was listed as “TBD.”

The pair married without a prenup and she’s requested that their assets be divided up by the court and considered as separate property. She also wants Masterson to pay her attorneys fees.

Additionally, Phillips has requested full custody of their 9-year-old daughter, Fianna, but she will allow their child to visit Masterson while he serves his 30-year sentence for rape.

“Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter,” her attorney, Peter A. Lauzon, said according to legal docs obtained by TMZ.

“This period has been unimaginably hard on the marriage and the family. Mr. Masterson was always present for Ms. Phillips during her most difficult times of her life,” the statement continued. “Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter.”

The Post reached out to Phillips’s rep for comment.

After his sentencing, Masterson’s legal team noted that they plan to appeal the court’s decision due to “substantial” errors they believe occurred during the trial.

“For the past several months, a team of the top appellate lawyers in the country has been reviewing transcripts of the trial. They have identified a number of significant evidentiary and constitutional issues which they will address in briefs to both the state and federal courts,” Masterson’s defense attorney, Shawn Holley, told reporters outside the courthouse on Sept. 7. 

“The errors which occurred in this case are substantial and unfortunately led to verdicts which are not supported by the evidence,” Holley added. “And though we have great respect for the jury in this case and for our system of justice overall, sometimes they get it wrong.” 

Masterson was found guilty of two counts of rape in May for sexually assaulting Jen B. and N. Trout in his Hollywood-area home in 2003. He was sentenced to 15 years for each count, which will be served consecutively.

This was the maximum sentence allowed under the law for the actor, who will be eligible for parole only after serving more than 25 years.
