Sophie Turner filed suit to get around divorce ruling: experts

Sophie Turner could be trying to get around a court order barring her from moving her kids outside of the US with her new lawsuit against estranged husband Joe Jonas, legal experts say.

New York matrimonial lawyers told The Post that Turner’s case is weak – and that it’s a bid to try to get out of the Florida ruling that restricts the parents from relocating their two young daughters amid their divorce.

“Sophie appears to be trying very hard to get the kids to England in violation of the Florida court’s prohibition,” Manhattan divorce lawyer Bernard Clair said.

“In short, she thinks that her petition here in New York is a way to do something indirectly, that she cannot do directly.”

The 27-year-old “Game of Thrones” actress claimed in the Manhattan federal suit from Thursday that the Jonas Brothers singer, 34, was refusing to allow their two daughters to return to their “forever home” in England.

Jonas – who abruptly filed for a divorce earlier this month – fired back in a statement from his rep claiming: “The Florida Court has already entered an order that restricts both parents from relocating the children.”

The spokesperson said Turner was served with the court order on Sept. 6 – the day after Jonas filed for divorce in Florida, seeking to end their four-year marriage.

“The reason she went to federal court is because she is seeking to trump the state court action where the divorce is pending, where there has already been a custody determination,” New York City Matrimonial lawyer Stuart Slotnick told The Post.

Turner filed suit using international child abduction laws – under the Hague Convention – meant for “heinous” situations when a parent runs away with kids to a foreign country, Slotnick explained.

These types of cases are normally shocking and “read of a terrible story of abduction,” Slotnick said.

“After you read it you should come to the conclusion that a heinous wrongful act has occurred and the child must reunited to one parent in their proper country,” Slotnick said. “There is nothing shocking here.”

Instead, Turner’s case involves a “couple getting divorced and one parent is unhappy with the result in one court so she went to a new one,” the jurist said.

Slotnick said the suit might be a legal tactic so that Turner can get permission to travel abroad with her kids.

Either way, divorces bring out emotions and can turn bitter very quickly, he said.

“These cases are a race to the bottom,” Slotnick said. “One party does something, the other party reacts and it gets ugly real fast.”

Clair, the Manhattan divorce lawyer, also said the case could end up being very “messy” – because of the divorce in Florida, the federal lawsuit in New York, and Turner’s intention to move the entire divorce case to England.

If the New York suit does go forward – and isn’t dismissed or paused for the Florida case – both lawyers said that Turner and Jonas would have to testify before a judge in Manhattan federal court, laying out evidence and putting on witnesses to bolster their arguments.

This could happen within a week, the attorneys said.

The whole suit could be wrapped up with a decision from a judge in under two months, Clair added.

Turner claimed she and Jonas moved the family – including Willa, 3, and their 1-year-old daughter whose name has yet to be confirmed – to England in April, according to her lawsuit.

The couple was in the process of buying a home that they would have moved into by December, But after the marriage “very suddenly” fell apart, Jonas allegedly refused to turn over the girls’ passports and allow Turner to take them back to England, the filing states.

Turner – who said she only found out about the divorce through the media – claimed the toddlers were enrolled in school, got medical and dental care there, and had even joined a theater group in the UK.

Turners’ partying ways reportedly factored into Jonas’ decision to split from the “Dark Phoenix” star, whom he married in May 2019 in Las Vegas when he was 29 and she was just 23.

The pair signed an ironclad prenuptial agreement that allows each to keep their own career earnings.

The children are said to live primarily with Jonas, and the singer is said to be caring for them “pretty much all the time.”

Turner’s penchant for partying is believed to have factored into the split, and a source said the pair have “very different lifestyles.”

Turner is suing Jonas for the return of their two daughters to England, the actress claims she found out her estranged husband filed for divorce “through the media.”

Jonas fired back at the lawsuit, claiming it goes against an “amicable co-parenting setup.”

The pair “had a cordial meeting” in New York City this past Sunday and Jonas thought “they had reached an understanding that they would work together towards an amicable co-parenting setup,” the rep claimed.

But less than 24 hours later, Turner changed her tune and “demanded” the kids’ passports so she could immediately take them to England – a move that would violate the Florida court order, Jonas’ spokesperson said.

The “Sucker” singer wants to co-parent with Turner and doesn’t even oppose raising the girls in both countries, the rep said.

“The children were not abducted,” the statement reads, adding that “[Jonas’] wish is that Sophie reconsider her harsh legal position and move forward in a more constructive and private manner.

“His only concern is the well-being of his children.”

Slotnick said that Jonas’ team’s statement shows he’s trying to take “the high road here.”

“We will see what happens and if she doesn’t reconsider her position and tactics,” Slotnick said.

A lawyer for Turner didn’t immediately return a request for comment.
